Terms of Service
Last updated: October 29, 2026
These terms apply to every data recovery case handled by Disklab Data Recovery (“Disklab”, “we”). By approving a quote in your client account, you (“the client”) agree to these terms.
Disklab Data Recovery, 12747 Olive Blvd, Suite 300, St. Louis, MO 63141. Phone 1 (844) 347-5522. Email info@disklab.co. Website www.disklab.co.
We may update these terms. The version in effect on the day you approve your quote applies to your case.
1. Free diagnostic and evaluation
The diagnostic is free. We do not quote prices before we evaluate the device, because symptoms alone do not show the cause of the failure.
Within 24 hours of starting the diagnostic, we post an evaluation report and a firm quote to your client account. You are under no obligation to approve it. If you decline, we return the device as received or dispose of it at your written request. Return shipping, if needed, is paid by the client.
2. Quote approval and card on file
To start recovery work, you approve the quote in your client account. When you approve, you choose:
- the recovery option from the quote
- the transfer media for your recovered data
- a backup plan, if you want one
- the delivery method
You also add a payment card. Your card is saved, not charged. Card details are entered directly into our payment processor’s secure form. Disklab never sees or stores your full card number.
By approving the quote, you authorize Disklab to charge the saved card for the approved amount only after you approve the file list, as described in section 3. A small temporary verification may appear on your card and is released by your bank.
3. File list approval and billing
You pay only if you approve the recovered data. After recovery, we post a file list to your client account so you can check that the files you need are there.
- If you approve the file list, we issue the invoice and charge your saved card for the approved recovery price, transfer media, backup plan, delivery and any applicable tax. A receipt is sent by email.
- If you decline the file list, there is no charge. This includes media, donor parts and labor.
Recovered data is released only after payment is complete.
4. Partial recovery
If only part of your data can be recovered, we post a revised quote together with the file list. Your card is charged only if you approve both the revised quote and the file list. If you decline either one, there is no charge.
The revised amount will never be higher than the quote you originally approved.
5. Transfer media, delivery and backup plans
Transfer media. When you approve the quote, you choose how to receive your recovered data from the options shown on your case page, such as a secure download link, new storage media, or a drive you provide. The options and prices shown when you approve the quote apply to your case. Media is charged only if you approve the file list.
Delivery. You can pick up at our St. Louis office or choose shipping. Shipped orders are sent by UPS, FedEx or USPS with tracking.
Backup plans. We keep a backup copy of your recovered data free for 30 days after delivery. If you want us to keep it longer, choose the number of extra months when you approve the quote. Each extra month is $30, charged to your saved card at the start of that month. You can cancel remaining months at any time by contacting us. When the backup period ends, the copy is securely deleted.
6. Response deadline
Please respond to the file list within 30 days of the day it is posted. We send email reminders during that period.
If we receive no response within 30 days, the case is closed with no charge, and the recovered data is securely deleted. The original device is returned or held for pickup as described in section 1. Deleted data cannot be restored, and a new recovery attempt would require a new quote.
7. Failed payments, refunds and records
Failed payments. If your saved card is declined or expired when we charge it, we email you a secure payment link. Recovered data is released once payment is received. Unpaid cases follow the 30-day deadline in section 6.
Refunds. If recovered files you approved do not open, contact us within 30 days of delivery. We will work to fix the issue, provide the data again, or issue a full or partial refund.
Records. Your client account keeps a time-stamped record of your quote approval, acceptance of these terms, file list approval and payment. We use these records to answer billing questions and payment disputes. Please contact us before filing a dispute with your bank; most issues are resolved quickly.
8. Risks, liability and confidentiality
Risks. Failed devices can degrade further during recovery. Some procedures, such as opening a drive in a clean room or removing memory chips, cannot be reversed. The original device may not be usable afterward. We describe the risks for your case in the evaluation report.
No guarantee. We cannot guarantee that any data will be recovered. You are never charged for a recovery you do not approve.
Liability. Our total liability for any case is limited to the amount you paid for that case. We are not responsible for loss of business, profits or indirect damages.
Confidentiality. Your data is handled only for your recovery. We do not view, copy or share file contents beyond what the work requires. Data is securely deleted as described in sections 5 and 6. See our Privacy Policy for how we handle personal information.
Governing law. These terms are governed by the laws of the State of Missouri.
